EU member states were required to transpose the EU Whistleblowing Directive into national law by December 2021. One year on, the majority of member states have yet to do so and the EU Commission has now commenced infringement proceedings against several member states. While some member states may have been slow to introduce new laws, we are likely to see the remaining member states introduce new laws in 2023.
In our two part series, we will be looking at members states that have transposed the Directive into national law (part 1) and at those who have yet to do so (part 2). We will be discussing some of the practical challenges that the Directive and national laws have created for multinational companies and explore ways of tackling these. We will also be looking at some of the areas where members states have gone beyond the scope of the Directive and asking the question as to whether or not multinational companies can adopt a “one size fits all” approach.
